What Documents are required for a Vehicle Ownership Transfer?
Transferring ownership of all motorized vehicles including cars in Bangladesh requires several documents. These documents are mainly needed for buying and selling old cars or other vehicles and for ownership changes due to inheritance. Some of the basic documents include: Vehicle Title Transfer Documents, Bill of Sale, Registration Certificate, Insurance Certificate, License Information, and Notarized Power of Attorney.
According to Bangladesh Road Transport Authority (BRTA) guidelines, if vehicle ownership is not transferred on time, legal problems may arise in buying and selling vehicles. Therefore, it is important to understand the ownership transfer process. The documents and procedures for buyers, sellers, and heirs are discussed below.
Necessary Documents for Vehicle Ownership Transfer in Bangladesh
Documents set by the Bangladesh Road Transport Authority (BRTA) must be carried for ownership transfer. Separate documents are required for the buyer, seller, and vehicle. In some cases, personal documents of buyer and seller may also be required. You can download the necessary forms from the BRTA website. Copies of all forms and documents must be attested.
Documents Required by Buyer
- Filled Transfer of Ownership (TO) form with buyer’s signature and specimen signature on TTO.
- Receipt of fee deposit (varies by vehicle type/CC).
- Copy of buyer’s TIN certificate (for personal vehicles only).
- Certificate of Registration/Digital Registration.
- Affidavit with buyer’s photograph on non-judicial stamp.
- Certificate of Insurance.
- Three copies of stamp-size color photographs.
If the buyer is an organization, all the above documents except affidavit and note with signature on the official pad are required.
Documents Required by Seller
- Filled and signed TTO form.
- Signed sales receipt.
- Affidavit with seller’s photograph on non-judicial stamp.
- Copy of seller’s TIN certificate (for personal vehicles only).
- Three copies of stamp-size color photographs.
- No Objection Certificate (NOC) from the seller.
If the seller is an organization, board resolution, authorization, and official pad signature are required. If the vehicle has a loan, clearance from the bank or institution must also be submitted.
Documents Required for Ownership Transfer through Inheritance
- Certificate of Inheritance granted by the Court.
- Filled TO form with heir’s signature and specimen signature on TTO.
- Receipt of prescribed fee deposit.
- Copy of heir’s TIN certificate.
- Registration Certificate/Digital Registration Certificate.
- Affidavit with heir’s photograph on non-judicial stamp confirming inheritance.
- Three copies of stamp-size color photographs.
If multiple heirs are involved and ownership is transferred to one, affidavits from other heirs with photographs on non-judicial stamps must be submitted.
Motor Vehicle Inspection and Biometric Process at BRTA
Once the documents and fees are submitted, the vehicle must be presented at the BRTA circle office at the scheduled time. Officials will verify the application and inspect the vehicle. If approved, a change of ownership permit or acknowledgment will be issued.
The receipt will include the biometric appointment date. On that date, the new owner’s biometric and photograph will be taken. A smart card registration certificate will be issued and must be collected on the specified date.
Problems if Ownership is Not Transferred
- If a vehicle registered in your name is sold without proper transfer and used in crimes, you will be held responsible.
- Purchasing a vehicle without proper registration may cause legal complications later.
- Providing false documents can lead to legal action from the other party.
- Failure to transfer ownership may result in a fine of up to Tk 5,000 under section 74 of the Bangladesh Traffic Act. A second offense may result in a Tk 10,000 fine.
